The Federal Supreme Court accepted the charges brought by the Office of the Prosecutor General against 31 of the 34 accused, formally making them defendants. The decision was rendered by the First Panel, composed of five justices.
The panel concluded there was sufficient evidence to initiate prosecution. Opening a criminal case marks the start of the proceedings, which guarantee the defendants’ right to a full defense. Attorneys may call witnesses, request the gathering of evidence, and the defendants may present their own accounts of the events.
In reviewing the charges, Reporting Justice Alexandre de Moraes stressed that the acts described by the Federal Police and the Office of the Prosecutor General culminated in the January 8, 2023 attack, when demonstrators breached security barriers, assaulted police officers, and violently occupied the seats of the Three Branches of Government.
According to the Justice, videos showing anti-democratic encampments across the country — particularly in Brasília in the days leading up to the vandalism of the Praça dos Três Poderes on January 8 — as well as an attempted bombing at Brasília Airport demonstrated the materiality and gravity of the actions in point.
The 31 defendants will stand trial for attempting to violently abolish the Democratic Rule of Law, attempting a coup d’état, participating in an armed criminal organization, causing aggravated damage through violence and serious threat to federal property, and deterioration of listed property.
Two of those investigated had the charges against them unanimously dismissed, as the justices found no specific conduct attributed to them and no concrete evidence presented.
A third defendant, residing in the United States, has not yet had his case reviewed after failing to respond to the summons to present a defense within the prescribed deadline. The Federal Public Defender’s Office has been appointed to represent him in absentia.
