Following the conclusion of the defendants’ interrogations, the Federal Supreme Court opened the period for both the Office of the Prosecutor General and the defendants to file their written closing arguments in the attempted coup d’état cases. The deadline expired on August 13, 2025.

This is the final stage of the evidentiary phase before the trial begins, when the defense and the prosecution present their concluding arguments, interpreting the evidence and testimony to support their positions ahead of the Court’s final decision.

Closing arguments are crucial for reinforcing each side’s perspective, clarifying any remaining doubts, and providing the foundation for the judgment, in line with the guarantees of a full defense and adversarial proceedings established under Brazilian law.

After this stage, the justices will review the entire body of evidence and the parties’ arguments to determine whether to convict or acquit the defendants. The president of the First Panel of the Federal Supreme Court, Justice Cristiano Zanin, will be responsible for setting the trial date.

Of the four criminal cases before the Supreme Court related to the matter, the one involving the so-called “crucial nucleus” is the most advanced. In its closing arguments in this case, the Office of the Prosecutor General expressed the view that the charges are supported by a broad array of evidence — handwritten notes, digital files, message exchanges, and spreadsheets — exposing the conspiratorial plot against democratic institutions.

According to the Office of the Prosecutor General, testimonies and examinations conducted throughout the proceedings would confirm the defendants’ involvement in a criminal organization with the aim of obstructing the functioning of the branches of government, overthrowing a legitimately elected administration, and vandalizing public buildings.

The Office of the Prosecutor General contends that the indictment should not be seen as a series of isolated incidents, but rather as a coordinated set of actions with a criminal purpose which, considered as a whole, were capable of producing the outcome punishable under criminal law.
